RoyseLaw regularly handles estate plans involving living trusts, wills, powers of attorneys and health care directives. Our deep tax expertise also allows RoyseLaw to plan and implement more sophisticated plans involving specialized techniques, such as generation skipping tax planning and Dynasty trusts, life insurance planning, family limited partnerships and limited liability companies, charitable planning and private foundations, international planning and asset protection.
Our estate planning practice includes the following:
Wills and Trusts. RoyseLaw can put in place basic estate plan documents including a living trust, wills, powers of attorney and health care directives.
Family Limited Partnerships. We have formed numerous family limited partnerships and limited liability companies designed to manage, control and facilitate the orderly operation and succession of family-held business assets. Often, if properly structured, the use of these entities will not only meet the business goals of the family but they will also result in gift and estate tax efficiencies.
Trusts. We are experienced in drafting and documenting the establishment of many types of estate planning trusts, including insurance trusts, children’s trusts, intentionally defective grantor trusts, grantor retained annuity trusts, qualified personal residence trusts, and split interest charitable trusts. Our tax focus allows us to be sensitive to more specialized issues such as ensuring that certain trusts are qualified subchapter S trusts or electing small business trusts (as may be appropriate).
Asset Protection Planning. We regularly advise on asset protection planning, including the establishment of foreign and domestic asset protection trusts.
Probate and Trust Administration. Our tax and estate planning attorneys handle estate administration, either through probate or during trust administration and advise executors, trustees, advisors, heirs, fiduciaries and beneficiaries on probate and trust administration matters. We also can assist in the preparation of fiduciary income tax returns, federal and state estate tax returns, and federal gift tax returns.
Public and Private Foundations. We regularly form California non-profit organizations as part of the wealth planning process and handle the application for recognition by the Internal Revenue Service and Franchise Tax Board of such organizations as exempt from federal and state income taxes.
Business Succession Planning. No tax or estate planning practice would be complete without an appreciation for wealth transfer issues. In conjunction with our business focus, we help business owners plan for the orderly and tax-efficient transfer of their assets to their heirs and beneficiaries. We are able to implement standard planning tools such as estate planning trusts, and more sophisticated techniques such as GRATS, sales to irrevocable grantor trusts and asset-protection planning.
